3. AUDIO RECORDINGS AND USER-GENERATED CONTENT

Bambini Sleep allows users to create, upload, store, synchronise, and replay personalised audio content. By recording, uploading, saving, syncing, or transmitting any audio or other User Content through the Services, you represent and warrant that:

● You own the content or have all necessary rights and permissions to use, record,

upload, store, and share that content through the Services;

● The content does not infringe any third-party copyright, privacy, confidentiality,

publicity, intellectual property, or other legal rights;

● Any personal, family, child-related, or sensitive material included in the content is

voluntarily provided by you;

● You have obtained any consent required from people whose voice, sounds, personal

information, or other material appears in the content;

● You will not upload unlawful, harmful, abusive, exploitative, invasive, or otherwise

inappropriate content.

You retain ownership of your User Content. However, you grant Bambini a limited,

non-exclusive, worldwide, royalty-free, revocable licence to host, store, copy, process, back up, synchronise, transmit, reproduce, and technically modify User Content solely as reasonably necessary to operate, maintain, secure, troubleshoot, and provide the Services.

Bambini Sleep does not routinely monitor or listen to private user recordings. However, we may access, review, restrict, preserve, or remove User Content where reasonably necessary to:

● Provide technical support requested by you;

● Investigate technical issues;

● Comply with legal obligations;

● Respond to complaints, disputes, or lawful requests;

● Investigate suspected misuse, unlawful conduct, or policy breaches;

● Protect the safety, security, or integrity of the Services.

You are responsible for maintaining your own backup copies of any personally important recordings or content. Bambini Sleep is not intended to be the only storage location for irreplaceable personal recordings.

4. SUBSCRIPTIONS, PURCHASES, AND BILLING

Premium subscriptions and in-app purchases are processed by third-party billing platforms, including the Apple App Store, Google Play, and any other payment provider made availablethrough the Services.

Bambini Sleep may receive purchase and subscription information required to manage

premium access, including:

● Successful purchase events;

● Subscription status;

● Trial eligibility;

● Renewal events;

● Cancellation events;

● Refund or reversal events;

● Expiry events;

● Billing platform customer identifiers;

● Restore purchase confirmations.

Bambini Sleep does not directly process or store full credit card, debit card, banking, or

payment account details. All billing transactions, renewals, cancellations, and refunds are subject to the rules, terms, and privacy practices of the relevant app marketplace or payment provider.

5. THIRD-PARTY SERVICE PROVIDERS

We may use trusted third-party service providers to assist with operating, securing,

improving, and supporting the Services. These may include providers of:

● Cloud hosting and storage;

safeguards designed to protect personal information and User Content from unauthorised access, misuse, loss, interference, alteration, or disclosure. However, no software system, cloud platform, device environment, or internet transmission

method can be guaranteed to be completely secure. Bambini Sleep does not guarantee absolute security, uninterrupted availability, or permanent preservation of User Content.

We retain personal information and User Content for as long as reasonably necessary to:

● Provide the Services;

● Maintain user accounts;

● Maintain backups;

● Provide subscriptions and restore purchases;

● Comply with legal, accounting, tax, and regulatory obligations;

● Resolve disputes;

● Investigate misuse, fraud, or security incidents;

● Enforce our agreements and legal rights.

Where information is no longer required, we may delete, anonymise, or de-identify it, subject to lawful retention requirements and technical backup cycles.

7. ACCOUNT DELETION AND DATA REMOVAL

Users may request deletion of their account and associated stored personal information through in-app settings where available, or by contacting Bambini Sleep support at hello@bambinisleep.com.

Following verification of the request, we will take commercially reasonable steps to delete, anonymise, or de-identify personal information and associated User Content within a reasonable timeframe.

Bambini Sleep may retain certain information where reasonably required for:

● Legal compliance;

● Tax, accounting, or audit obligations;

● Billing verification;

● Fraud prevention;

● Dispute resolution;

● Backup integrity;

● Security investigations;

● Enforcement of contractual or legal rights.

Deletion of your Bambini Sleep account may not automatically cancel an active subscription purchased through the Apple App Store, Google Play, or another billing platform. You are responsible for cancelling subscriptions through the relevant billing platform.

8. CHILDREN’S PRIVACY

Bambini Sleep is intended for use by parents, guardians, and adult caregivers.

Children are not permitted to create accounts, purchase subscriptions, or upload content through the Services.

We do not knowingly solicit or collect personal information directly from children for the purpose of allowing children to operate their own account.

Any child-related recordings, names, sleep sounds, or associated content uploaded to the Services are deemed to have been voluntarily provided by the authorised adult account holder.

Parents, guardians, and caregivers are solely responsible for deciding whether any

child-related content is appropriate to record, upload, store, or synchronise through the

Services. If you believe a child has provided personal information to Bambini Sleep without appropriate parental or guardian involvement, please contact us at support@bambinisleep.com so we can review and take appropriate action.

9. INTERNATIONAL DATA TRANSFERS

Bambini Sleep and its service providers may process, transfer, or store information on

servers located in Australia, the United States, the European Economic Area, or other

jurisdictions in which our service providers operate.

Where required by applicable law, we take commercially reasonable steps designed to

ensure that overseas recipients handle personal information consistently with applicable privacy and data protection requirements.

By using the Services, you acknowledge that your information may be transferred, stored, or processed outside your country of residence.

10. ANALYTICS, DIAGNOSTICS, AND SERVICE IMPROVEMENT

We may use analytics, crash logs, diagnostics, and technical performance information to:

Bambini Sleep provides audio relaxation, comfort, and sleep-support tools for general

wellness purposes only. The Services do not provide medical advice, psychological treatment, behavioural therapy, therapeutic diagnosis, clinical sleep treatment, or healthcare recommendations. Bambini Sleep does not guarantee that use of the Services will improve sleep, prevent waking, treat a medical condition, resolve infant sleep issues, or achieve any particular outcome. Users remain solely responsible for seeking appropriate professional advice for medical, developmental, behavioural, or sleep-related concerns.

12. YOUR PRIVACY RIGHTS

Depending on your location and applicable law, you may have rights to:

● Request access to personal information we hold about you;

● Request correction of inaccurate personal information;

● Request deletion of certain information;

● Object to or restrict certain processing;

● Withdraw consent where processing is based on consent;
